1. Our supply process and these terms

AMING HOSPITALITY (we, us) supplies equipment as the seller identified in your written quote and invoice. We accept enquiries from businesses and individuals in New Zealand. These terms apply to new orders placed under this version, together with the written quote and any expressly agreed special terms. Changes to website terms do not retrospectively change an existing contract. Nothing here excludes, restricts or modifies a right or remedy that cannot lawfully be excluded.

2. Online purchases, applications and quotations

The website offers online purchasing alongside a separate quote request service. An enquiry or delivery order application is not a confirmed order, does not take payment and does not reserve stock. For delivery, we verify the equipment, stock, address and services before sending a full payment link through a Shopify draft order. A draft payment link or card authorization does not itself confirm stock reservation or readiness. We confirm acceptance of an order in writing after our checks; an automated receipt acknowledgement alone is not that acceptance. Written quotations have the stated validity period. If a price or service change is needed, we obtain your agreement before proceeding, subject to applicable law.

3. Prices, GST and payment

Amounts are in NZD; applicable GST, freight and agreed additional services are shown before payment. Ordinary cards including Visa and Mastercard and bank transfer are offered. Cards are accepted only when the discounted merchandise subtotal excluding GST, freight and additional service fees is NZ$2,000 or less. Above that amount, bank transfer is required. This is manually reviewed, not an automatic checkout restriction; a card authorization above the limit will be canceled without capture and we will contact you about transfer. Clearly linked or intentionally split orders are reviewed together. All card orders are checked before capture. We arrange procurement only after actual receipt in AMING's bank account. The approximate 5–7 working days after card capture is a planning estimate for settlement and bank receipt, not a guaranteed deadline; initial payouts, bank processing and review can take longer. Preparation and transport time are additional. Payment confirmation is not collection or dispatch confirmation. We do not unilaterally increase an agreed price; cancellation and refunds remain subject to the agreed terms and applicable law. Any deposit is credited to the order; it is not automatically forfeited.

4. Product selection and site information

You must provide accurate contact, delivery and site information and tell us about material requirements, including intended use, access, dimensions, electrical supply, gas type, water, drainage and ventilation. Check the written quote, model and configuration before accepting. Engage suitable licensed installers where required. We remain responsible for representations or advice we actually provide and for applicable obligations concerning suitability. Images may illustrate a range; the agreed model and written specification identify the supplied equipment. We will obtain agreement before substituting a materially different product.

5. Delivery, pickup and optional services

Delivery is not automatically free. Freight and service scope are confirmed per order before payment; small orders may attract a carrier minimum charge. Standard delivery is to a safely accessible vehicle delivery point with unloading arrangements agreed in advance. It does not automatically include tail-lift unloading, indoor handling, unpacking, placement, installation, stairs or removal of old equipment. Rural or difficult access, special handling and redelivery may cost extra. All foreseeable fees are confirmed before payment; address, quantity or service changes require a revised quote. Choose Pickup in your cart to see the corresponding collection warehouse and address. Items at different collection locations require separate checkouts. Collection is permitted only after AMING sends the collection-ready notice and collection document. Authorized third-party collection must be arranged in advance. Orders may arrive in separate consignments, as confirmed by AMING. Dates are estimates unless expressly agreed otherwise; we notify you of material delays and discuss a solution. Existing non-excludable rights remain unaffected. Risk passes as agreed in the quote only to the extent permitted by law; consumer delivery rights are preserved. We retain ownership until the agreed price has been paid, to the extent legally permitted.

6. Cancellation, returns and faults

Contact us promptly if you need to change or cancel an order. Before order acceptance, an enquiry can be withdrawn without an order cancellation charge. After acceptance, change-of-mind cancellation or returns need our written agreement. Any proposed deduction must reflect reasonable, disclosed costs or losses, taking account of costs avoided and applicable rights. Special orders, customised goods and equipment already installed or used may not qualify for discretionary returns. Faulty, damaged, incorrectly supplied or misdescribed goods are handled separately under the Returns and Warranty policies and applicable law.

7. Warranty and services

Manufacturer or supplier warranties differ by product, usage, registration and service area. Only the warranty and additional services expressly confirmed for the model are promised. We coordinate claims through the relevant supplier where appropriate, but a supplier's refusal or delay does not remove any obligation we owe you under applicable law. Insurance, loan equipment, installation and consequential-loss cover are not included unless expressly agreed. If a third party contracts with you directly, their service terms must be provided for your agreement; describing a service as third-party does not remove responsibility for services we ourselves agree to supply.

8. Business purchases and limits of liability

Where both parties acquire and supply the goods or services in trade, the buyer acquires them for business purposes, and it is fair and reasonable to do so, the parties agree in writing that the Consumer Guarantees Act 1993 does not apply to that supply. This clause does not apply merely because a company name is entered. For qualifying business supplies, to the extent permitted by law and fair and reasonable in the circumstances, our aggregate liability relating to an affected supply is limited to the price paid for the affected goods or services, and we exclude indirect or consequential loss such as lost profits or business interruption. These limits do not apply to fraud, wilful misconduct or liability that cannot lawfully be limited. No blanket exclusion of the Fair Trading Act is intended. The written quote must draw these business terms to the customer's attention before agreement.

9. Problems, events beyond control and contact

Tell us promptly about a problem so we can investigate and work towards a remedy. Events reasonably beyond either party's control may affect performance; the affected party must communicate and take reasonable steps to reduce the impact. This does not automatically remove cancellation, refund or other rights under applicable law. New Zealand law applies, without removing any mandatory protection.
